In regards to the 'all clears', despite a building being fully swept, the police have full discretion in deciding when they let people back into the buildings. People's names, evacuation plans, detailed building and sweeping plans, discussion of the police response, whatever. Setting aside the actual legality of discussing information directly received on the air, most of it is not appropriate anyway. I don't have a problem with the initial threats being posted before the ENS messages (however I ask that you do your best to make sure evacuations are taking place and that there has been an actual threat)

The legality of discussing information directly received from on air communications doesn't seem cut and dry to me (lawyers have been known to be wrong in their interpretations). I don't know where people are getting this one from. I have never said that it's illegal to listen to the scanner. I wasn't expecting another one of these threads to pop up. Element two of the offense is not satisfied because the initial interception was not illegal. § 2511(1)(c) are: (1) the act or acts of disclosing or endeavoring to disclose to another person the contents of a wire, oral or electronic communication (2) the doing of such act or acts knowing or having reason to know that the information was obtained through an illegal interception of a wire, oral or electronic communication and (3) the doing of such act or acts intentionally."īecause (2)(g)(ii)(II) provides that it is lawful to intercept radio transmissions from law enforcement, it is not illegal to disclose that information to others.
